Before altering duties, shifts or assignments, each measure and its effect on the exercise of this right must be assessed.

It is prohibited to take retaliatory or disciplinary action for exercising the right to strike.

It is prohibited to use coercion, threats or pressure regarding the decision to participate or not in a strike.

PRACTICAL GUIDELINES FOR COMPANIES

Before the strike:

Plan operations and review the organisational measures envisaged, avoiding the replacement of striking employees or the neutralisation of the strike’s effects.

Avoid asking employees for advance information about their intention to take part in the strike.

During the strike:

Record each employee’s participation objectively and on an individual basis.

Ensure respect for employees’ freedom, both for those who take part in the strike and those who decide not to participate.

After the strike:

Calculate individually and apply the relevant wage deductions.

Submit the relevant notifications to the General Treasury of Social Security, ensuring compliance with applicable procedures and deadlines.

Review any incidents that occurred during the working day. Before taking any disciplinary action, ensure that the conduct in question is distinct from the legitimate exercise of the right to strike and that it is duly substantiated.

FINAL RECOMMENDATION

The priority is to ensure that the organisation of work is compatible with respect for the right to strike and the freedom of those who choose not to take part in it.

Prior to the strike on 11 November 2026, we recommend reviewing the planned organisational measures and coordinating with those responsible for personnel and payroll regarding the recording of incidents, wage deductions and notifications to the social security authorities.

Our Employment Law team is at your disposal to assess your company’s circumstances and address any queries that may arise before, during or after the strike.

Employment Law Department
Giménez Torres Abogados

In light of the general strike called for 11 november 2026, we summarise its main employment law implications and the guidelines that businesses should bear in mind when organising their operations whilst respecting the right to strike.
